					This California Consumer Privacy Act Privacy Notice (“**CCPA Notice**”) supplements the **3marketeers Advertising, Inc.** (“**3marketeers**”, “we,” “us,” or “our”) **Privacy Policy** and applies solely to individuals who reside in the State of California (“**California residents**” or “you”) and who visit or interact with our website located at **3marketeers.com** (the “Site”). This CCPA Notice is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations (collectively, the “CCPA”). Terms defined in the CCPA (such as “personal information,” “sell,” “share,” and “business purpose”) have the same meaning when used in this CCPA Notice.

This CCPA Notice does not apply to 3marketeers&#039; employees, job applicants, owners, directors, officers, or contractors, or to personal information collected in a business-to-business context that is otherwise exempt from certain CCPA provisions, except to the extent required by law. It also does not apply to information collected offline or through means other than the Site unless otherwise indicated.

In the 12 months preceding the Effective Date above, we collected the following categories of personal information about Site visitors, as defined by the CCPA. We do not collect all categories from every visitor — the information collected depends on how you interact with the Site (for example, whether you submit a form, request a demo, or simply browse).

*3marketeers  does not knowingly collect Social Security numbers, driver&#039;s license numbers, financial account credentials, precise geolocation, health information, biometric information, or other sensitive personal information through the Site. If sensitive personal information is ever collected (for example, if voluntarily submitted in a free-text field), we use it only for purposes permitted under the CCPA and do not use it to infer characteristics about you.*

###### How We Use Personal Information

We use the categories of personal information described above for the following business and commercial purposes:

 	- Operating, maintaining, and improving the Site and our marketing automation platform and related services (the “Services”);

 	- Responding to inquiries, providing customer support, and fulfilling requests for demos, trials, whitepapers, or other content;

 	- Marketing and advertising our Services, including email marketing, retargeting, and personalized content, where permitted;

 	- Understanding how visitors use the Site through analytics, and diagnosing technical issues;

 	- Maintaining the security and integrity of the Site and our systems, and detecting and preventing fraud or malicious activity;

 	- Complying with applicable legal obligations, enforcing our agreements, and protecting our legal rights; and

 	- Other purposes disclosed to you at the time the information is collected, or as otherwise permitted or required by law.

###### Sources of Personal Information

We obtain the categories of personal information described above from the following sources:

 	- Directly from you, when you fill out a form on the Site (e.g., “Request a Demo,” “Contact Us,” newsletter sign-up), register for an account, or otherwise communicate with us;

 	- Automatically, through your use of the Site, via cookies, web beacons, pixels, and similar tracking technologies;

 	- From service providers that assist us with website hosting, analytics, marketing automation, and email delivery; and

 	- From publicly available sources and third-party business data providers (e.g., professional/company information used for B2B marketing purposes).

###### Disclosure of Personal Information for a Business Purpose

We may disclose the categories of personal information identified in Section 1 to the following categories of third parties for a business purpose:

 	- Service providers and contractors that perform functions on our behalf, such as website hosting, IT and cloud infrastructure, marketing automation and email delivery, analytics, and customer relationship management;

 	- Professional advisors, such as legal, accounting, and financial advisors;

 	- Affiliates and related entities; and

 	- Government authorities or other third parties where required by law, regulation, or legal process, or to protect the rights, property, or safety of 3marketeers, our users, or others.

We require our service providers and contractors to use personal information only for the purposes for which it was disclosed and in a manner consistent with this CCPA Notice, and we enter into CCPA-compliant contracts with them where required.

###### “Selling” and “Sharing” of Personal Information

3marketeers does **not sell** personal information to third parties in exchange for money.

However, like many websites, the Site uses third-party cookies and similar tracking technologies (for example, for advertising and analytics purposes) that may constitute a “**sharing**” of personal information (specifically, Internet or network activity information such as browsing behavior) with third-party advertising or analytics partners for cross-context behavioral advertising, as that term is broadly defined under the CCPA. You have the right to opt out of this sharing at any time as described in Section 7 below.

We do not have actual knowledge that we sell or share the personal information of California residents under the age of 16.

###### Retention of Personal Information

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this CCPA Notice, including to provide the Services, comply with our legal and contractual obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected; where no specific legal or contractual retention period applies, we generally retain personal information for no longer than is reasonably necessary for the applicable business purpose.

###### Your California Privacy Rights

Subject to certain exceptions and limitations under the CCPA, California residents have the following rights with respect to their personal information:

**Right to Know / Access**
Request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business/commercial purpose for collecting it, and the categories of third parties with whom it is shared, covering the 12 months preceding your request (or a longer period where we retain the information).

**Right to Delete**
Request that we delete personal information we have collected from you, subject to certain exceptions permitted by the CCPA (e.g., to complete a transaction, detect security incidents, comply with a legal obligation).

**Right to Correct**
Request that we correct inaccurate personal information we maintain about you.

**Right to Opt-Out of Sale/Sharing**
Direct us not to “sell” or “share” (as those terms are broadly defined under the CCPA, which includes certain uses of cookies for cross-context behavioral/targeted advertising) your personal information.

**Right to Limit Use of Sensitive Personal Information**
3marketeers does not use or disclose sensitive personal information for purposes other than those permitted under the CCPA without a limitation request; where applicable, you may direct us to limit such use.

**Right to Non-Discrimination**
We will not deny you goods or services, charge different prices, or provide a different level or quality of goods or services because you exercised a CCPA right.

**Right to Appeal**
If we decline to act on your request to know, delete, or correct, you may appeal that decision using the contact information below.

###### How to Exercise Your Rights

You may submit a request to exercise your rights to know, delete, or correct through either of the following methods:

###### Your form has been submitted.
We&#039;ll send a confirmation to your email address. Please be sure to verify your signup.

To opt out of the “sharing” of your personal information for cross-context behavioral advertising, you may use the “**Your Privacy Choices**” or “**Do Not Sell or Share My Personal Information**” link available in the footer of the Site, adjust your cookie preferences through our cookie consent banner/preference center, or submit a request using the contact information above. Where technically feasible, we honor opt-out preference signals, such as the Global Privacy Control (GPC), as an exercise of your opt-out rights.

Verification. To protect your privacy and security, we will take steps to verify your identity before responding to a request to know, delete, or correct. We may ask you to provide certain information that allows us to reasonably verify that you are the person about whom we collected personal information, or an authorized representative. The amount and type of information we request may vary depending on the sensitivity of the personal information at issue and the type of request made. We will not require you to create an account to submit a request, though you may be asked to use an existing account to help verify your identity.
Authorized Agent. You may designate an authorized agent to submit a CCPA request on your behalf. To do so, the agent must provide us with signed written permission from you (or documentation demonstrating the agent&#039;s authority to act on your behalf, such as a power of attorney), and we may still require you to independently verify your own identity and directly confirm with us that you provided the agent permission to submit the request.
Response Timing. We will confirm receipt of your request within 10 business days and endeavor to respond substantively within 45 calendar days of receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. If we deny your request, in whole or in part, we will explain the basis for the denial and inform you of your right to appeal using the contact information above.

###### Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: deny you goods or services; charge you different prices or rates; provide you a different level or quality of goods or services; or suggest that you may receive a different price, rate, level, or quality of goods or services, because you exercised your rights under the CCPA. 3marketeers does not currently offer financial incentives in connection with the collection, sale, or deletion of personal information collected through the Site.

###### Shine the Light

Separate from the CCPA, California&#039;s “Shine the Light” law (Cal. Civ. Code § 1798.83) permits California residents who have an established business relationship with us to request certain information regarding our disclosure, if any, of personal information to third parties for their own direct marketing purposes during the preceding calendar year. 3marketeers does not disclose personal information to third parties for their own direct marketing purposes. If this practice changes, you may submit a Shine the Light request using the contact information in Section 8.

###### Do Not Track Signals

Some browsers offer a “Do Not Track” (DNT) signal. Because there is not yet a common industry standard for recognizing DNT signals, the Site does not currently respond to DNT browser signals; however, we do honor the Global Privacy Control (GPC) signal as described in Section 8 above.

###### Minors

The Site is intended for a business audience and is not directed to children under the age of 16, and we do not knowingly collect personal information from children under 16 through the Site. If you believe a child has provided us with personal information, please contact us using the information in Section 13 below.

We may update this CCPA Notice from time to time to reflect changes in our data practices or applicable law. We will post the updated notice on the Site with a revised “Last Updated” date. Your continued use of the Site after any changes constitutes your acknowledgment of the updated CCPA Notice.
